This is an informative translation. The Spanish version is the legally binding one. Condiciones de alquiler
1.1 These general conditions apply to all motorhome or caravan rental contracts between CARAVANAS JUAN, S.L. and its customers, governing the contractual relationship between them together with any contracts the parties may sign setting out the particular conditions of each case (whether to make a booking or for another service).
1.2 The sole purpose of the contract with the renter is the rental of the motorhome or caravan and, where applicable, of the extra and optional accessories offered by the owner and booked by the customer in advance.
1.3 When a booking is made, the renter and the owner(s) enter into a rental contract governed exclusively by Spanish law. The renter organises their own trip and uses the vehicle under their own responsibility. The rental contract is limited to the agreed duration. Tacit extension of the rental contract for an indefinite period through continued use is excluded.
1.4 All agreements between the owner and the renter shall be made in writing, whether electronically, by post or in person.
2.1 The renter and each driver must be at least 25 years old and hold a category B driving licence for more than 2 years, or the corresponding national licence. Non-EU residents must hold a valid International Driving Permit for this type of vehicle. Each additional driver is charged the daily amount set out in the owner's price list in force when the booking is made.
2.2 The owner's vehicles have a gross weight of 3.5 tonnes or less, so a category B driving licence is required to drive them.
2.3 Holding a category B licence is an essential requirement for the contract. If it is not held, or has not been held at any point, CARAVANAS JUAN, S.L. may terminate the contract.
2.4 Only the renter and the drivers named in the rental contract who meet the conditions in section 2.1 may drive the vehicle. When booking the vehicle, the main driver must send the owner valid copies of the following documents: national identity card (DNI) or, failing that, passport; European driving licence or, failing that, international driving licence; a credit card valid for the 6 months following the rental date; a recent bill or receipt (no more than 2 months old) for a household service (phone, water, electricity, bank, etc.) confirming their address. The originals of these documents must be shown when the vehicle is picked up. The customer expressly authorises the owner to charge to their credit card, within the following twelve months, the financial consequences of any personal offence committed during the rental.
3.1 Rental prices are taken from the owner's price list in force when the contract is made. The minimum rental period at certain times of year is also taken from that price list. Depending on the nights booked, the prices listed for the corresponding season apply. A single fixed amount is charged per rental for the services provided, which can also be found in the owner's price list in force when the contract is made.
3.2 Rental prices for optional accessories are taken from the owner's price list in force when the contract is made.
3.3 The minimum rental is 3 nights and the maximum 45 nights.
3.4 Rental prices include: VAT, 350 km per night, fully comprehensive insurance according to the corresponding cover (see section 11 below), and the mobility guarantee of the chassis-cab manufacturer or insurer. Rentals allow a maximum of 350 km per day, with each extra kilometre costing 0,30 euros plus VAT.
3.5 The rental period starts when the renter picks up the motorhome at the rental centre and ends when the rental centre's staff take the vehicle back.
3.6 If the renter returns the motorhome late after the time agreed in their contract, the owner may charge 60€ plus VAT for each hour of delay (up to a maximum of 600€ plus VAT per day).
3.7 If the vehicle is returned before the end of the contracted rental period, the full agreed rental price must still be paid, and the owner is not obliged to refund any amount.
3.8 The motorhome is handed over with a full fuel tank and must be returned the same way. Otherwise, the owner will charge 3€ gross per litre of diesel. Fuel and maintenance costs during the rental are paid by the renter. The vehicle runs on DIESEL only; biodiesel is expressly prohibited. All costs caused by using a fuel other than DIESEL are paid by the customer.
3.9 Returning the vehicle to a different centre from the pick-up one requires a special agreement with the owner and payment of the amount for this service, agreed before the motorhome is picked up.
4.1 Bookings are only binding once confirmed by the owner, as set out in section 4.2, and only for vehicle groups, not for specific models or vehicles. This also applies when a specific vehicle is given as an example in the description of the vehicle group.
4.2 Once the owner has given written confirmation of the booking, a deposit of 30% of the total rental amount must be paid within ten days at most. From then on, the booking is binding on both parties. If the renter does not meet this deadline, the booking is no longer binding on the owner. If the customer cancels a binding booking, they must pay the following cancellation charges, calculated from the first confirmed booking:
4.3 The rental dates can be changed once only, with the express agreement of CARAVANAS JUAN, S.L.. To be valid, the change must be notified at least 15 days in advance. The new date must be given at the time of the change and must fall within the 6 months following the original first day of rental. This service carries a surcharge of 20% of the total rental, with a minimum of 100€ plus VAT.
4.4 In accordance with article 103.l) of Spanish Royal Legislative Decree 1/2007 of 16 November (consolidated text of the General Law for the Defence of Consumers and Users), as this is a vehicle rental service for a specific date or period, the renter does not have the fourteen-day right of withdrawal that applies to distance contracts. Cancelling the booking is governed by section 4.2.
5.1 The rental price for the booked dates must be paid into the account provided by the owner no later than 7 days before the start of the rental.
5.2 At the latest when picking up the vehicle, the renter must pay 800 € by credit card as a security deposit, guaranteeing that the obligations of this contract are fulfilled.
5.3 For short-notice bookings (7 days or less before the rental date), the full rental price is due immediately and is paid when booking.
5.4 The security deposit is returned from 48 working hours after the vehicle is returned and after it has been inspected by a member of the owner's staff, who, in the event of damage through misuse or any missing items from the handover inventory, will determine the amount the customer must pay. This amount is deducted from the deposit, and the renter accepts paying the difference if the cost of the damage exceeds the deposit. If the damage cannot be assessed immediately, the owner has 60 days to settle and return the deposit where applicable, or to claim the difference between the deposit and the cost of the damage. In the event of a claim, the excess of the fully comprehensive insurance is also deducted from the deposit. If the renter is due any compensation on rental paid in advance, it is returned together with the deposit.
5.5 The security deposit is used to cover the cost of any loss of or damage to equipment, accessories, extras, repairs or negligent damage to the rented vehicle or extras.
5.6 The renter expressly agrees to pay the owner:
5.7 Any damage caused to a third party or to the owner that is not covered by the vehicle's insurance and can be valued at that time, without prejudice to section 5.4.
5.8 If the renter pays late, default interest is charged in accordance with the law.
6.1 Before setting off, the renter must follow the instructions given by the owner's technical staff at the pick-up point. A handover report (check in) is drawn up describing the condition of the vehicle and the inventory on board, to be signed by both parties. The owner may refuse to hand over the vehicle until the instruction on how to use it has been given.
6.2 When returning the vehicle, the renter must carry out a final inspection of the vehicle together with the rental point's staff. A return report (check out) is drawn up, to be signed by the owner and the renter. Damage not recorded in the handover report but found when the vehicle is returned is charged to the renter. For returns outside office hours, the renter must send the owner photos/videos to notify the return of the vehicle.
6.3 As a general rule, vehicles are handed over Monday to Friday from 16:00 to 19:00, and returned Monday to Friday before 11:00. The times stated in the rental contract are those agreed. On Saturdays and Sundays handovers and returns are only possible with prior agreement and for an additional charge at the current rate. The pick-up and return days together count as one day, provided that in total they do not exceed 24 hours, or exceed them only for reasons attributable to the owner.
6.4 Unauthorised late returns are charged under clause 3.6. Any justified case of force majeure preventing the return on the agreed day must be reported to the owner immediately for acceptance; otherwise it is considered an unauthorised delay.
6.5 If the renter wishes to extend the rental, they must ask the owner at least 3 days before the contract ends. Any extension is subject to the owner's availability at that time, and the owner makes no prior commitment.
6.6 Any change to the rental dates must be authorised by the owner in advance. Failure to do so entitles the owner to take back the vehicle or claim it through the courts. The owner reserves the right to recover the vehicle at any time during this contract if it is used in breach of the contract or of these general conditions.
6.7 When the vehicle is returned at the end of the rental and the renter is not present at the inspection for reasons attributable to them (key-box return or unavailability), and damage is found, the renter accepts the assessment of the damage made by the owner's staff.
6.8 The vehicle must be returned as clean inside and out as it was on the first day of the rental. When returning the vehicle, the grey water and toilet tanks must be empty. Otherwise, a cleaning supplement is charged according to the established rates.
6.9 Filling the drinking water tank with diesel or another fuel, or the diesel tank with water or another fuel, carries a penalty of 750€ + VAT.
7.1 The renter acknowledges receiving the vehicle in perfect mechanical condition, with the necessary documents and the appropriate tools, tyres and accessories, and undertakes to keep it in good condition. The renter also undertakes to comply at all times with the obligations and limits of the traffic regulations in force, and agrees:
7.2 The vehicle must be looked after, treated properly and locked. Technical rules and the instructions for use must be followed. The condition of the vehicle, the water and oil levels and the tyre pressure must be checked. The renter undertakes to check regularly that the rental motorhome is in perfect condition to be driven safely. If the vehicle is damaged by overheating due to low engine oil or coolant levels, the customer loses the whole security deposit.
7.3 Smoking is prohibited in all vehicles. Pets (dogs only) may be taken if the owner has expressly authorised it under their conditions. Cleaning costs arising from any breach are paid by the renter, who must also pay the costs of airing the vehicle or removing the smell of tobacco, including losses from not being able to rent the vehicle for some time for this reason.
7.4 If the provisions of sections 7.1, 7.2 and 7.3 above are found to have been breached, the owner may terminate the rental contract immediately and request the return of the vehicle, and the renter must pay the full rental price plus the costs listed in those sections.
8.1 In the event of an accident, theft, fire or damage caused by game animals, the renter must inform the police and the owner immediately by calling the rental centre (the number is in the rental contract), at the latest on the working day after the accident. The renter must pay for all damage or loss caused by not informing the owner of any of these events, or informing them late.
8.2 Liability must never be admitted or presumed, except through the "European Accident Statement", bearing in mind that it must be endorsed by the insurers involved. The renter must obtain all the details of the other party and of any witnesses and send them, with the details of the accident, to the owner within the stated period. Report the accident to the authorities immediately if the other party is at fault. The accident report must be handed in, fully completed and signed, at the latest when the vehicle is returned to the owner. It must include the name, address and phone numbers of the people involved, their driving licence details, the other party's details with the name of their insurer and policy number, details of any witnesses and the registration numbers of the vehicles involved.
8.3 In the event of theft of the vehicle, it must be reported to the competent authority immediately, informing the owner and sending them a copy of the report, together with the vehicle's keys, within 24 hours at most; otherwise the insurance and cover taken out cease to apply.
8.4 Even for damage with no other party involved, whatever its severity, the renter must write the owner a full written report with a sketch. If the renter does not write the report, for whatever reason, and this prevents the insurer from paying for the damage, the renter must pay the full amount.
8.5 Do not leave the vehicle without taking suitable measures to protect and safeguard it. If necessary, contact the roadside assistance company arranged with the insurer.
8.6 If the customer fails to take any of these measures, where applicable, the owner may claim from the renter the damage and loss caused by their negligence, including the owner's loss of earnings while the vehicle is out of use.
9.1 The renter has no right to compensation for defects not attributable to the owner.
9.2 When returning the vehicle, the renter must tell the owner in writing about any defects found in the motorhome or its equipment after the start of the rental. There is no right to compensation for defects reported later, unless the claim concerns damage that was not evident.
10.1 Normal mechanical wear of the vehicle is borne by the owner. When the length of the journey or the state of the roads makes it advisable, the necessary maintenance must be carried out at an official dealer of the chassis-engine brand.
10.2 The renter must stop the vehicle as soon as possible when any warning light indicating a fault comes on, and contact the owner or the assistance company arranged by the owner, and only that company, going exclusively to an official dealer of the chassis-engine brand unless the owner expressly authorises otherwise.
10.3 The renter may order repairs needed to keep the vehicle safe to operate and drive during the rental that do not exceed 150€. This only requires the owner's approval. The owner pays for the repair on receiving the original receipts and the replaced parts, provided the renter is not liable for the damage under section 11. Damage to tyres, wheels, windscreens and windows during the rental is excluded from this rule and is always paid by the renter.
10.4 If such a repair is needed because of damage attributable to the owner and the renter does not arrange it, the renter must report the fault to the owner without delay and allow reasonable time for it to be repaired. The owner is not responsible for country-specific conditions (e.g. infrastructure) that delay the repair.
10.5 In the event of any fault in the vehicle or the living area, the renter must inform the owner immediately and will receive instructions on how to have it repaired.
10.6 If, through no fault of the renter, the motorhome is seriously damaged, is expected to be unusable for more than 48 hours or must be taken off the road, and the customer is within 500 kilometres of the rental centre, the owner, if available, must provide the renter within 48 hours at most with a replacement vehicle with the same number of seats or more. Termination of the contract is excluded, so the customer must accept the new vehicle, and the owner is not obliged to compensate any loss or damage to the customer.
10.7 If, through the renter's fault, the motorhome is seriously damaged, is expected to be unusable for a long time or must be taken off the road, the owner may refuse to provide a replacement vehicle. In this case the renter may not terminate the contract and must pay the full rental price, plus the costs caused by their actions. If the owner can provide a replacement vehicle, they may charge the renter any resulting costs.
11.1 The owner has an insurance policy for the rented vehicle. The cost of the policy is included in the rental price. Under this insurance, in the event of comprehensive damage, the owner releases the customer from liability for material damage to the vehicle, subject to the excess stated for each vehicle on its page and in the contract, which the renter must pay. The excess is not the security deposit in section 5: the deposit is paid at pick-up and returned after the vehicle is checked; the excess is the maximum the renter pays in the event of a claim. A copy of the policy is given to the renter at this point, together with the insurance payment receipt, as stated in this contract signed by the parties in agreement. The renter undertakes to comply with the particular and general conditions of the insurance.
11.2 Under no circumstances is the renter released from civil, administrative, criminal or any other liability arising from a claim or from wilful or negligent conduct.
11.3 The release from liability in section 11.1 does not apply if the renter fails to follow any of the rules in sections 7 and 8.
11.4 The renter is liable for wilful or negligent conduct in the following cases:
11.5 The renter is liable for all costs, fees, fines and penalties related to the use of the vehicle that are claimed from the owner, except where attributable to the owner.
11.6 Where there are several customers and/or drivers, all of them are jointly and severally liable.
12.1 The owner hands over the vehicle in perfect condition, having carried out all the checks and maintenance needed for it to work properly. The owner is not responsible for mechanical failures or breakdowns due to normal wear, nor for any costs, delays or loss caused directly or indirectly by such failures or breakdowns.
12.2 If, due to force majeure or reasons beyond the owner's control, the vehicle cannot be handed over on the agreed date, this gives no right to compensation, other than the owner refunding the amount paid as a booking deposit.
12.3 The owner accepts no liability to the renter for the renter's car left, as free parking, at the owner's premises during the motorhome rental.
12.4 The owner is fully liable in cases of wilful misconduct and gross negligence. In cases of slight negligence, the owner is only liable, up to the foreseeable damage set out in the contract, where an obligation of particular importance for achieving the purpose of the contract (a cardinal obligation) is breached. This also applies where obstacles to providing the service arise when the contract is made.
12.5 Vehicles may have a system for locating them and monitoring their condition.
12.6 The General Commercial Conditions displayed at the rental centre when the rental period begins apply.
12.7 These "General Rental Conditions" bind the parties from the moment the booking is made and form an integral part of the vehicle rental contract.
